Terms and conditions
The terms for using the Prover app
This English version is a convenience translation. Only the German version is legally binding. Where the two differ, the German version prevails.
1. Scope and provider
These general terms and conditions (the "terms") apply to the use of the Prover app (the "app").
The provider of the app is:

By registering for and using the app, you accept these terms. Please read them carefully before you use the app.
2. Subject matter
The Prover app is a fitness application that enables you to:
- Create and manage individual training plans
- Perform and log workouts
- Track your training progress
- View exercises with instructions
- Log your nutrition and manage calorie and macro targets, optionally with adaptive adjustment based on the data you log
- Optionally connect your daily step count from Apple Health or Health Connect (see the privacy policy)
The app supports your training and does not replace professional advice from doctors, physical therapists or certified trainers.
Some of these features are paid. The details are in section 4.
3. Registration and account
Requirements:
- You must be at least 16 years old
- You need a valid email address
- You must provide truthful information
Account security:
- You are responsible for keeping your login details secret
- Do not share your login details with third parties
- Inform us immediately of any unauthorized access
Only one registration is permitted per account.
4. Prover Premium: trial, subscription and prices
Some of Prover's features are paid and are grouped under the name Prover Premium. You can see which features are included at any time on the app's pricing screen.
Trial:
If you have not tried Prover Premium before, your subscription starts with a free trial of 30 days. Whether you are eligible for a trial is decided by the respective store; the information shown to you immediately before the purchase is decisive. Nothing is charged during the trial. If you do not cancel at least 24 hours before it ends, it automatically converts into the paid subscription at the price shown. If you cancel during the trial, you can use Prover Premium until it ends and you incur no costs. The trial can be used once per store account.
Contracting party for the purchase:
You do not conclude the subscription with us but with the operator of the respective app store: with Apple for a purchase through the App Store, with Google for a purchase through Google Play. The store handles payment, invoicing, renewal, cancellation and refunds. The terms of the respective store also apply.
Prices and term:
Prices are shown to you in the app before the purchase as a total price including statutory VAT. You can choose between a monthly and an annual term. The price shown to you immediately before the purchase is decisive.
Automatic renewal:
The subscription automatically renews for the chosen period unless it is canceled at least 24 hours before the end of the current period. The store charges the payment at the start of the new period.
Cancellation:
You cancel the subscription in the subscription management of your app store. From the app, you reach it in your profile under Manage subscription, even during the trial. After you cancel, you can use Prover Premium until the end of the period already paid for. Deleting your Prover account does not end the subscription; cancel it in the store as well.
Right of withdrawal:
For contracts for digital content, there is generally a right of withdrawal of 14 days. It expires if you expressly agree to the immediate start of performance and confirm that you thereby lose your right of withdrawal. Since the respective store is your contracting party, you send any withdrawal and refund requests to Apple or Google.
Price changes:
If the prices for running subscriptions change, Apple or Google will inform you in good time before the change takes effect. You can cancel until the end of the current period; if you do not cancel, the new price applies from the following period.
5. Rights of use
When you register, you receive a non-exclusive, non-transferable right to use the app for private purposes.
You may:
- Use the app on your personal devices
- Create training plans for your own use
- Store and retrieve your training data
You may not:
- Use the app commercially without permission
- Copy, modify or redistribute the app
- Circumvent or tamper with security measures
6. Prohibited use
The following uses are prohibited:
- Distributing unlawful, offensive or harmful content
- Attempting to manipulate or overload the app or its servers
- Using automated systems (bots, scrapers) without permission
- Circumventing access restrictions or security measures
- Using the app to harm other users
In the event of violations, we reserve the right to suspend or delete your account.
7. Intellectual property
All rights to the app, including:
- Design and user interface
- Exercise descriptions and instructions
- Logos and trademarks
- Source code and software
remain with us or our licensors.
The training plans you create and your personal data belong to you. By uploading them, you grant us only the rights of use that are technically necessary to provide the app's services.
8. Limitation of liability
Health notice: The app does not replace medical advice. Consult a doctor before starting a training program, especially in the case of:
- Pre-existing conditions
- Pregnancy
- A long time without training
You train at your own risk.
Technical availability: We strive for high availability of the app but cannot guarantee uninterrupted availability. Maintenance work and technical disruptions are possible.
Exclusion of liability: To the extent permitted by law, we are not liable for:
- Indirect damage or lost profits
- Data loss due to technical problems
- Damage resulting from use despite health concerns
9. Termination
You can terminate your account at any time:
- Directly in the app in your profile under Delete account
- By email to prover.app.dev@gmail.com
Upon termination, all your data is deleted in accordance with our privacy policy.
A running subscription does not end when you delete your account. Cancel it in the subscription management of your app store as well (see section 4).
We may terminate or suspend your account in the event of:
- A violation of these terms
- Suspected abuse
- Prolonged inactivity (with prior notice)
10. Changes to these terms
We reserve the right to change these terms:
- If the legal situation changes
- If new features are added to the app
- To clarify existing provisions
We will inform you of material changes by email or in-app notification at least 14 days before they take effect.
If you do not object to the changes within 14 days of being notified, the new terms are deemed accepted.
11. Final provisions
Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Place of jurisdiction: The statutory place of jurisdiction applies. Mandatory consumer protection provisions of the country where you live remain unaffected.
Severability: Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
